Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website auttendo.com (the "Website"), the design and build of a website by Auttendo for a customer, the hosting and management of that website, and the editing of that website via WhatsApp (together the "Service"). The Service is operated by Dazzled VOF ("Auttendo", "we", "us", "our"), established at Hoedemakerplein 3 Room 6, 7511 JR Enschede, the Netherlands, KvK 89338731. By using the Service you agree to these Terms. If you do not agree, you may not use the Service.
1. Definitions
- "Customer" means a business or individual that purchases a website from Auttendo.
- "Customer Content" means anything you provide to us for use on your site, including photos, texts, opening hours, menus, prices, logos, brand assets and any other materials.
- "Site" means the website that Auttendo builds, hosts and maintains for the Customer.
- "Change" means a request submitted by the Customer (typically via WhatsApp) to update the Site.
- "AI" means the third-party large-language-model service that Auttendo uses to execute Changes.
2. Eligibility and account
You must be at least 18 years old and capable of entering into a binding agreement. If you use the Service on behalf of a business, you confirm that you have authority to bind that business. You must provide accurate information, keep your contact and billing details up to date, and report any unauthorised use of your account to us.
3. The Service
Auttendo provides a website-as-a-service for business owners, consisting of:
- A complete redesign and build of your Site, done by senior designers and accelerated by AI.
- Hosting, domain management and SSL.
- Editing of your Site through WhatsApp, executed by AI with human review where appropriate.
- Advice on what works for your business, when you ask.
We do not build custom software, marketplaces, dashboards, login systems or e-commerce checkouts. If you need those, there are better tools, and we will tell you so.
4. Customer Content
4.1 Ownership
You retain ownership of all Customer Content. You grant us a limited, non-exclusive licence to host, copy, display, adapt and process Customer Content as needed to provide the Service.
4.2 Your responsibilities
You confirm that you have the right to share each piece of Customer Content with us (for example, you own the photos, or you have permission from the photographer). You are responsible for the accuracy and legality of all Customer Content.
4.3 Prohibited content
You may not provide Customer Content that is unlawful, infringes third-party rights, contains malware, is misleading, or is otherwise harmful. If we become aware of prohibited content, we may remove it without notice.
5. Changes via WhatsApp and fair use
After your Site is live, you can request Changes by sending us a WhatsApp message. Changes typically go live within a few minutes. We commit to the following:
- There is no per-Change fee. Changes are included in your monthly fee.
- There is no hard cap on the number of Changes per month. We operate on a fair-use basis. In practice, that means as many Changes as your business actually needs.
- If your usage is materially out of line with normal business use (for example, hundreds of Changes per day, automated scripted submissions, or use that prevents us from serving other customers), we may ask you to reduce volume or move to a custom plan.
- For larger additions, such as a whole new page, a new integration with a third-party tool, or a substantial redesign of an existing section, we will discuss scope and timing with you before starting.
Changes are reviewed by our designers where appropriate. If you spot something wrong with a Change after it goes live, send another WhatsApp message and we will correct it.
6. Acceptable use
You may not:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile or bypass any security or rate-limiting controls.
- Interfere with the operation of the Service or attempt to access data of other customers.
- Use the Service to host content depicting minors in a sexual context, content inciting violence, or any content that violates Dutch or EU law.
- Resell, sublicense or repackage the Service to third parties without our written consent.
7. Prices and payment
7.1 Pricing
Pricing is shown on auttendo.com/prijzen and is the leading reference. The headline structure is: a one-time setup fee from €899 to build your Site, plus a monthly fee of €79 for hosting, management and Changes. All amounts are in euros, excluding VAT.
7.2 Setup fee
The setup fee is due before we start the build. The fee covers the complete design and build of your Site, including three revision rounds, your domain setup, hosting and SSL setup, and bringing the Site live within one week of design approval.
7.3 Monthly fee
The monthly fee starts once your Site is live and is billed monthly in advance, in euros and excluding VAT. We accept bank transfer and direct debit (SEPA). The monthly fee covers hosting, beheer (management), Changes via WhatsApp on a fair-use basis, and advice when you need it.
7.4 Late payment
If a payment is more than 14 days overdue we may, after sending a reminder, suspend the monthly Service until payment is received. We will not delete your Site during a suspension period of up to 60 days.
7.5 Price changes
We may change the monthly fee with at least 30 days notice. Continued use after the change date is acceptance. If you do not agree, you may cancel as described in Section 11.
8. AI execution of Changes
Many Changes are executed by a third-party AI system (currently Anthropic Claude) acting on our instructions, with human review where appropriate. You acknowledge that:
- AI may make mistakes. We aim to catch them with human review, but we do not guarantee pixel-perfect or error-free output on every Change.
- If a Change is not what you wanted, send another WhatsApp message. We will correct it as part of the monthly Service at no extra cost.
- Customer Content you send via WhatsApp for the purpose of executing a Change is shared with our AI sub-processor for that purpose. See our Privacy Policy for details.
9. Availability and support
We aim for high availability of the hosted Site but do not guarantee uninterrupted access. Scheduled maintenance, security updates and third-party service incidents may cause temporary unavailability. Support is provided via WhatsApp and email at hi@auttendo.com.
10. Disclaimer and limitation of liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including loss of revenue, loss of data or business interruption. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Dutch law.
11. Termination and what happens to your Site
11.1 By you
You may cancel the monthly Service at any time by sending a WhatsApp or email. Cancellation takes effect at the end of the current monthly billing period. There are no partial refunds for the running month.
11.2 By us
We may suspend or terminate the Service if you materially breach these Terms, if your payment is significantly overdue (see Section 7.4), if continued provision creates a legal or security risk, or if we discontinue the Service entirely (with reasonable advance notice).
11.3 Your domain
Your domain remains in your name throughout the relationship. On termination we will transfer authority of the domain to you or to the registrar of your choice.
11.4 Your Site after termination
On termination we export your Site to a static backup so that you receive a complete copy of what was live. After delivery of the backup and the agreed transfer of the domain, we deactivate hosting and delete the operational copy of your Site in line with our Privacy Policy retention schedule.
12. Intellectual property
We own all rights in the Auttendo brand, the auttendo.com website, the internal tooling we use to build and edit Sites, and any underlying templates or frameworks we develop. Once your Site is live and your setup fee has been paid in full, the visual design and content of your Site is yours to keep (subject to the licences we hold for third-party fonts, photos or tooling embedded in it).
If you send us feedback or suggestions, we may use that feedback to improve the Service without any obligation to you.
13. Governing law and disputes
These Terms are governed by the law of the Netherlands. Any dispute will be brought exclusively before the competent court in the district of Overijssel, the Netherlands. EU consumers retain the mandatory consumer protections of their country of residence and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Severability
If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent needed to make it enforceable, and the remaining provisions will stay in full force.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will give at least 30 days notice by email or by posting a notice on auttendo.com. Continued use of the Service after the change date is acceptance.
